6. Governing Law and Jurisdiction

These Terms of Use, your use of the platform, and any dispute, controversy, or claim arising out of, relating to, or in connection with them, their subject matter, or their formation (including any non-contractual disputes or claims) shall be governed entirely by and construed strictly in accordance with the substantive and procedural laws of the jurisdiction in which BCA777 maintains its principal place of operations, without giving effect to any choice of law or conflict of law provision, principle, or rule that would cause the application of the laws of any other jurisdiction.

7. Dispute Resolution Mechanisms

Any disputes, claims, or controversies arising under or in connection with these Terms of Use, the services provided by BCA777, or the relationship between you and us shall first be attempted to be resolved through good faith, amicable negotiations between the parties. You agree to contact our customer support team to attempt to resolve the issue before pursuing formal legal action. If the dispute cannot be satisfactorily resolved informally within thirty (30) calendar days of the initial notification, it shall be exclusively and finally submitted to binding arbitration in accordance with the prevailing rules of a recognized and accredited arbitration association located in our operating jurisdiction. The arbitration proceedings shall be conducted on an individual basis only, and explicitly not as a class, consolidated, or representative action. The written decision of the appointed arbitrator shall be final, binding, and non-appealable on both parties.

8. Account Termination and Suspension

BCA777 explicitly reserves the right, in its sole, absolute, and unfettered discretion, to suspend, disable, restrict, or permanently terminate your account and your access to all or any part of the platform at any time, for any reason or no reason, with or without prior notice or liability to you. Typical reasons for suspension or termination may include, but are not necessarily limited to, a verified or suspected breach of any provision of these Terms of Use, suspected fraudulent, deceptive, or illegal activity, prolonged account inactivity, or mandatory requests by law enforcement, regulatory bodies, or other government agencies. Upon the termination of your account, all licenses and rights previously granted to you in these Terms will immediately and automatically cease. You acknowledge that you will not be entitled to any form of compensation, reimbursement, or refund for any virtual items, digital currency, or financial balances remaining in your account at the exact time of termination.

9. Indemnification

You unconditionally agree to defend, fully indemnify, and hold entirely harmless BCA777, its parent company, subsidiaries, affiliates, licensors, and service providers, as well as its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and permitted assigns, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable, documented attorneys fees and legal costs) arising out of, resulting from, or relating to your violation or breach of these Terms of Use. This indemnification obligation also broadly covers your use or misuse of the platform, including, but not limited to, any unauthorized use of the platform content, services, and products.

10. Severability and Waiver

If any specific provision or clause of these Terms of Use is held by a competent court, arbitrator, or other tribunal of competent jurisdiction to be invalid, illegal, void, or legally unenforceable for any reason, such specific provision shall be eliminated, modified, or limited to the absolute minimum extent necessary such that all the remaining provisions and clauses of these Terms of Use will continue in full force and effect. No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms of Use shall operate or be construed as a waiver thereof.
